terms of service !

By commissioning me, you agree to the following terms. If you commission or purchase a design from me without reading these terms of service beforehand, I am not responsible for any misconceptions, disagreements, or consequences later on.You are not permitted to repost or sell my work without my permission. Posting artwork to your toyhou.se or another form of character storage is acceptable with no prior discussion so long as it is credited properly.DRAWING LIMITATIONS
➥ I will draw: most feral animals, anthro animals, human(oid)s, simple to complex designs
➥ I will not draw: mechs, intricate clothing, nsfwPAYMENT AND REFUNDS
I only accept payment through PayPal, Venmo, and CashApp unless an alternative source is already stated or discussed. Payment is upfront - work will not begin until payment is received. In cases of purchases $150 or above, payment plans can be discussed. If you require special circumstances, please discuss them with me so we can make a plan that works for both of us. In special circumstances where all payment is not received upfront, the product will not be delivered until it is all received.Refunds are only given out on a case-by-case basis. Full refunds will only be given out if the sketch has not been completed and shown to the commissioner or if more than three months have passed with no progress. If the sketch phase has already been completed and shown to the commissioner, a partial refund may be given depending on the circumstance. In the case of any refund, all work (adoptable or commission) defaults back to me to reuse as I wish and is not permitted to be used by the refundee.GENERAL
➥ You can repost with permission (if necessary) and credit, use any artwork as an icon/wallpaper/header, add on the price of my art or design to the worth of the character.
➥ You can not erase my watermark, claim the art or design as your own, use my artwork or designs for NFT/AI/Blockchains, use my art/designs commercially without proper discussion of payment, trace or steal my artwork/designs.Turnaround can range anywhere from a day to two months. I will attempt to update you on any delays or changes.I retain the right to post my art or designs/adoptables unless requested to not do so beforehand.If you upload my designs or artwork to Toyhous.e, please credit my TH account @absinthe.If you, at any time, issue a chargeback or similar action, your rights to any and all characters and art I have created are revoked and will be repossessed. These actions will render our agreement void and you will be added to my blacklist.I do not do business with any of the following: terfs, nazis/nazifurs, homophobes, racists, transphobes, pedophiles, zoophiles, etc. If you fall into any of these groups and are discovered later, you will be automatically added to my blacklist and everything I created for you will be revoked.Unless otherwise discussed for commercial licensing, I retrain the rights to every image I produce; the character is fully yours (if commissioned), but the artwork is still copyrighted to me and can only be used non-commercially.COMMISSIONS
➥ You can crop my artwork, resize it, color tint it.
➥ You can not crop out my watermark, edit out my watermark, or alter the image drastically.You will receive one sketch of the commission - this is your chance to let me know about any changes or alterations you want to the posing, character, or anything regarding the commission. Do not be afraid to ask for changes here! After your approval, you will receive the final piece upon its completion.The finished piece will only have a simple background unless otherwise requested. Depending on the commission type, you may request simple stickers, shapes, photos, or gradients for the background. Please let me know if you want a transparent version!If, upon completion of the commission, you want alterations you may be charged for changes. This will be discussed with you when these requests are brought up. Major changes to posing or the artwork will result in you being charged the full or half price of the work depending on how complex or time-consuming they are to complete. Changes to the coloring or fixing design mistakes that I may have made will be free if not requested in excess.If, for any reason, you require an unwatermarked version of the artwork, please ask me to provide it instead of altering it yourself. I will typically only do this if you plan on using the work for a pose on a website or online game but other exceptions may be discussed.DESIGNS AND ADOPTABLES
➥ You can use the design as a mascot/fursona (noncommercially), make small edits to the design.
➥ You can not drastically alter the design or artwork, cover/hide/crop my watermark, claim the design as your own.Drastically changing or otherwise altering a design is not permitted. Changing the name, gender, age, sexuality, accessories, and the like (unless stated otherwise) is perfectly acceptable. Heavily redesigning a character to the point where they are unrecognizable/their own character will result in a discussion about the repossession of the original design.In regards to 'litters,' creating litters using my designs is not permitted without approval. This is simply a sneaky way to copy a design I have created if done without permission and will result in you being placed on my blacklist.The character is not yours until you have paid in full. If you have only partially met the terms we agreed upon, the character does not and will not belong to you until said payment has been completed. Selling/trading a design or character before you have completed payment will result in the design being revoked and you being placed on the blacklist.You cannot resell a character for more than you purchased it for unless you have added value to it yourself (e.g. commissioning art for them, etc). I do not generally count your own art as adding value to the design/character.As the designer of the character, this terms of service will automatically overwrite any buyers'. Any attempts to overwrite my terms of service (including, but not limited to, replacing my terms with your or another artists', removing my terms of service from view, or purposefully attempting to hide my terms) will result in one warning to fix the error. If you refuse, you will be immediately placed on my blacklist.COMMERCIAL USE
Any artwork or design created by me cannot be used commercially without written consent. This includes using them as VTubers, commercialized personas where their likeness is sold (whether this is via stickers, shirts, or some other form of commercialization), promotional illustrations, etc. If you wish to use the design for commercial purposes, you must contact me so we can discuss proper pricing, the potential passing of copyright, and the like.

general pricing

All listed prices are the minimum amount for each given commission type. It is wise to be prepared to pay more. Prices may increase because of a variable of factors, including but not limited to additional requests made, complex clothing and design, and more-than-expected hours required to complete the project. Any price increases due to hours will be discussed with the commissioner prior. All other additional chargers will also be discussed with any given client should they apply.General additional charges are:
- Shading is an additional $5-10, depending on commission type and complexity.
- Complex clothing can range from simply $10 to over $25 depending on the time required to draw it.
- Complex designs are typically on a case-by-case basis but may be $10-15 more.

clean art

Full rendering is an additional $20-30.
Background can be photo, transparent, simple color, simple shapes, or minimal elements.
Props are an additional $5-15, depending on complexity.
Non-chibi humans are an additional $15-30 depending on size.

icons - $25

Backgrounds will be plain or simple shapes.
The style is more simple for icons.
Rendering is an additional $10.

sketches

By default, sketch will be colored white.
Full coloring is an additional $5.
Simple color background. Transparency can be requested.
Cleaner lines are an additional $5.
Props and complex clothing are an additional $5-15, depending on complexity.

blacklist !

Individuals on my blacklist are not allowed to own characters I've designed, commission me, or use artwork created by me. I will refuse to conduct business with them in any form.Artwork created by me must be removed. Designs that enter the hands of blacklisted individuals will be revoked if not returned to the previous owner.If you see someone on my blacklist partaking in any of the behaviors listed above, evading the blacklist by creating new accounts, or having third parties purchase from me in their name, please inform me immediately!
